# Class Deviation 2017-O0009 # Class Deviation 2017-O0009 Products and Services from the African Host Nation-Djibouti Status: Active Date Issued: September 2017 Scope: All DoD contracting officers acquiring products or services in support of DoD activities in Djibouti Authority: Section 899A of the National Defense Authorization Act for Fiscal Year 2017 (Pub. L. 114-328) ## Summary This deviation implements section 899A of the FY2017 NDAA by establishing enhanced authority to acquire products and services from Djibouti, the covered African host nation, in support of DoD activities there. Contracting officers may either limit competition to Djiboutian sources or apply a price evaluation preference in favor of those sources, provided a written determination is made beforehand. The Balance of Payments Program and the FAR Part 25.4 trade agreements procedures do not apply to acquisitions conducted under these authorities. ## Required Contracting Officer Actions 1. Before using a procedure under DFARS 225.7798-3(a), prepare and execute a written determination in accordance with 225.7798-4, using either the individual or class determination template provided in Attachments 2 and 3. 2. Include the applicable written determination in the contract file. 3. Ensure each contract action taken under a class determination is within the scope of that determination and document the contract file accordingly. 4. Include the appropriate deviation provision or clause in solicitations and contracts: 252.225-7985 when providing a preference (paired with 252.225-7986), 252.225-7986 when a preference applies, or 252.225-7977 when competition is restricted to Djiboutian sources. 5. Insert the applicable price evaluation factor percentage in paragraph (d) of 252.225-7985 in accordance with USAFRICOM Commander's policy and contracting activity procedures. 6. Do not include Buy American or Balance of Payments clauses (252.225-7000, 7001, 7002, 7035, 7036, 7044 or 7045) in solicitations or contracts that contain any of the three deviation provisions or clauses. 7. Do not include 252.225-7020 or 252.225-7021 in solicitations or contracts that include 252.225-7977. 8. Trade agreements procedures inapplicable: When competition is limited to Djiboutian sources under 225.7798-3(a)(1), the procedures of FAR subpart 25.4 do not apply. AbilityOne products excepted: The authority under 225.7798-3(a) is not available for products on the Procurement List under 41 U.S.C. 8503(a) if a qualified nonprofit agency for the blind or for other severely disabled can produce and deliver the product in a timely fashion. Approval thresholds: The contracting officer may make an individual determination for acquisitions valued at less than $93 million. The head of the contracting activity, without power of redelegation, must make the determination for individual acquisitions valued at $93 million or more or for class determinations.
