L. 114-328) ## Summary This memorandum establishes a one-time deviation pilot program under Section 830(d) of the FY2017 NDAA to accelerate contracting and pricing processes for up to 10 Foreign Military Sales contracts covering full rate production of major weapon systems. Contracting officers approved for the pilot may base price reasonableness determinations on actual cost and pricing data for DoD purchases of the same product, in lieu of the standard FAR 15.4 procedures. The pilot grants broad discretion in determining the amount of certified cost and pricing data required under 10 U.S.C. 2306a for each applicable procurement. ## Required Contracting Officer Actions 1. Obtain prior approval from the Director, DP/DPAP before participating in the pilot by submitting the application template to osd.pentagon.ousd-atl.mbx.dpap@mail.mil 2. In lieu of using FAR 15.4 Contract Pricing procedures, base price reasonableness determinations on actual cost and pricing data for purchases of the same product for the Department of Defense 3.
