L. 118-31) ## Summary This deviation grants temporary special acquisition authorities under Section 843 of the FY2024 NDAA, allowing contracting officers to use elevated micro-purchase and simplified acquisition thresholds for contracts that directly support time-sensitive or unplanned combatant command operations. Acquisitions made under this authority may be treated as commercial product or commercial service acquisitions. The deviation remains in effect until September 30, 2028, unless rescinded earlier. ## Required Contracting Officer Actions 1. Send a copy of the combatant commander's request and the HCA-approved determination to Defense Pricing and Contracting (DPC) at osd.pentagon.ousd-a-s.mbx.dpc-cp@mail.mil within 7 days of receipt of the determination. 2. Include the request and approved determination in the contract file. 3. Enter '2024-O0011' in the 'Description of Requirements' data element, along with the actual description of what is being procured and the most appropriate value in the 'Emergency Acquisition' data element in the contract action report for all contracts awarded under this deviation. 4. Upon notification from the combatant commander that a covered operation has concluded, notify DPC via email at osd.pentagon.ousd-a-s.mbx.dpc-cp@mail.mil that the covered operation has ended. ## Notes HCA Approval Required: Use of these special acquisition authorities is not self-executing. The combatant commander must submit a written request and determination to the HCA, and the HCA must approve it before any elevated thresholds or commercial-item treatment may be applied. The HCA's approval authority is not delegable below the senior contracting official. Threshold Applicability: Elevated thresholds differ based on place of performance. Micro-purchase thresholds are $20,000 inside the United States and $35,000 outside. Simplified acquisition thresholds are $800,000 inside the United States and $1.5 million outside. Simplified procedures under FAR subpart 13.5 apply to purchases above the simplified acquisition threshold up to $15 million. Commercial Treatment: Contracting officers may treat acquisitions of supplies or services under this deviation as acquisitions of commercial products or commercial services, regardless of whether they would otherwise qualify as such.
