This deviation implements section 853(a) of the NDAA for Fiscal Year 2025. It prohibits Department of Defense from entering into or renewing contracts for covered semiconductor products and services with any entity that knowingly supplies those products and services to Huawei. Two new Defense Federal Acquisition Regulation Supplement (Defense Federal Acquisition Regulation Supplement) instruments, provision 252.240-7998 and clause 252.240-7999, implement this prohibition.

Required actions:

1. Do not enter into or renew a contract for covered semiconductor products and services with any entity that knowingly provides covered semiconductor products and services to Huawei.

This class deviation prohibits Department of Defense contracting officers from requiring greenhouse gas (GHG) disclosures as a condition of contract award. The prohibition applies to nontraditional defense contractors indefinitely and to traditional defense contractors through December 22, 2026. Contracting officers must not consider GHG emission information submitted via Federal Acquisition Regulation 52.204-7, System for Award Management representations.

Required actions:

1. Do not require any nontraditional defense contractor to disclose a GHG inventory or any other GHG emissions report as a condition of contract award.
2. Do not require any traditional defense contractor to disclose a GHG inventory or any other GHG emissions report as a condition of contract award through December 22, 2026.

2024-O0005, Class Deviation 2024-O0005 – Temporary Authorizations for Covered Contracts Related to Ukraine, Taiwan, and Israel

This deviation rescinds Class Deviation 2023-O0003 Revision 2 and extends temporary acquisition flexibilities to covered contracts related to Ukraine, Taiwan and Israel. Contracting Officers may use noncompetitive procedures, elevated thresholds and streamlined authorities for qualifying contracts. The deviation remains in effect until September 30, 2028.

Required actions:

1. Determine whether a contract qualifies as a 'covered contract' under the definitions in paragraph (A) before applying any deviation authority.
2. When using paragraph (B) authority, notify congressional defense committees and Defense Pricing and Contracting (DPC) at osd.pentagon.ousd-a-s.mbx.dpc-cp@mail.mil no later than 7 days before contract award.
3. After award using any deviation authority, notify congressional defense committees and DPC within 7 days of award with all required reporting elements per paragraph (H)(2).
4. Apply elevated micro-purchase thresholds ($20,000 inside the U.S.; $35,000 outside) and simplified acquisition thresholds ($800,000 inside the U.S.; $1,500,000 outside) for covered contracts.
5. Use Federal Acquisition Regulation Subpart 13.5 simplified procedures for covered contracts up to $15 million when market research supports commercial product or service offers.
6. For sole-source awards over $20 million treated as commercial, do not exempt the contract from cost accounting standards or certified cost or pricing data requirements.
7. For undefinitized contract actions on covered contracts, obtain head-of-agency waiver before exceeding Defense Federal Acquisition Regulation Supplement (DFARS) 217.7404 limitations.
8. For multiyear procurements under paragraph (G), apply only to the listed munitions and systems; confirm applicable DFARS 217.170 and 217.172 exemptions before proceeding.

2024-O0002, Class Deviation 2024-O0002, Revision 1 – The Service-Disabled Veteran-Owned Small Business Program

This class deviation revises and supersedes Class Deviation 2024-O0002, issued December 8, 2023. It provides an alternative to using the System for Award Management (SAM) to verify eligibility of Service-Disabled Veteran-Owned Small Business (SDVOSB) concerns. Contracting officers must check the Dynamic Small Business Search (DSBS) instead of SAM to confirm SDVOSB certification.

Required actions:

1. Do not use SAM to verify SDVOSB concern eligibility for set-aside or sole-source awards under the SDVOSB Program.
2. Check DSBS at https://web.sba.gov/pro-net/search/dsp_dsbs.cfm to verify that the offeror is certified as an SDVOSB concern.
3. Use these alternate verification procedures in lieu of the procedures at Federal Acquisition Regulation 19.1403, 19.1405(c) and 19.1406(b) that require a SAM check.

2024-O0001, Class Deviation 2024-O0001 – Implementation of Injunction of Executive Order 14026, Increasing the Minimum Wage for Federal Contractors

Contracting Officers must not use Federal Acquisition Regulation (FAR) 52.222-55 in solicitations or contracts where Texas, Louisiana or Mississippi (or their agencies) are a party. This restriction applies regardless of place of performance and covers extensions, renewals and option exercises. It implements a federal court injunction blocking enforcement of Executive Order 14026 minimum wage requirements against those three states.

Required actions:

2023-O0006, Class Deviation 2023-O0006 – Limitations on the Procurement of DoD Non-Tactical Vehicles

Contracting Officers may not obligate Department of Defense (DoD) funds to procure non-tactical electric, advanced-biofuel-powered or hydrogen-powered vehicles that do not comply with Federal Acquisition Regulation (FAR) subpart 22.15. This prohibition extends to components and spare parts for such vehicles. It implements section 328(c) of the FY 2023 NDAA and applies regardless of dollar value.

Required actions:

1. Do not obligate any DoD funds to procure non-tactical electric, advanced-biofuel, or hydrogen-powered vehicles that do not comply with FAR subpart 22.15.

This deviation prohibits Department of Defense from procuring covered items containing PFOS or PFOA effective April 1, 2023. It revises and supersedes the original Class Deviation 2022-O0010 issued September 23, 2022. The revision clarifies prescriptions for the new solicitation provision and contract clause.

This deviation requires Contracting Officers (COs) to submit proposed individual nonavailability waiver determinations to the Made in America Office (MIAO) for review before award. COs must use the digital waiver portal at SAM.gov and cannot award until MIAO confirms it completed or waived its review. It also requires COs to insert Defense Federal Acquisition Regulation Supplement (DFARS) 252.225-7001 instead of Federal Acquisition Regulation (FAR) 52.225-1 when a nonavailability waiver applies.

Required actions:

1. Execute an individual nonavailability waiver determination when no domestic end product offer is received under full and open competition synopsized per FAR 5.201, in lieu of the FAR 25.103(b)(3) exception.
2. Submit all proposed individual nonavailability waiver determinations under FAR 25.103(b)(2) or in lieu of FAR 25.103(b)(3) to MadeinAmerica.gov via SAM.gov for MIAO review, unless the urgency or class-listed nonavailability exception applies.
3. For urgent acquisitions exempt from pre-award MIAO review, report the waiver through the SAM.gov digital portal within 30 days of award.

Contracting Officers may not enter into or renew contracts for unmanned aircraft systems (UAS) or UAS detection systems manufactured or controlled by Chinese entities. Two new Defense Federal Acquisition Regulation Supplement deviation clauses implement this prohibition. Exceptions apply for counter-UAS testing and certain intelligence and electronic warfare operations.

Required actions:

1. Do not enter into or renew a contract for a UAS, related services or equipment, or a UAS detection system that is manufactured by or connected to People's Republic of China entities.

This deviation responds to COVID-19 by allowing debarring and suspending officials to deliver notices and decisions electronically. Officials may use email or secure file exchange in addition to certified mail. Contractors must receive instructions for submitting opposition in writing, in person or via phone or video-teleconference.

Required actions:

1. Debarring and suspending officials may deliver suspension and proposed debarment notices via email or secure file exchange, in addition to certified mail with return receipt requested.
2. Initial suspension or proposed debarment notices sent by email must include copies of the record that formed the basis for the decision, per Defense Federal Acquisition Regulation Supplement Appendix H-101.
3. Include instructions for contractors to present opposition or evidence in writing via mail or email, in person, through a representative or via telephone or video-teleconference as the suspending and debarring official deems appropriate.

2020-O0013, Class Deviation 2020-O0013 – Revision 4 - CARES Act Section 3610 Implementation

This revision to Class Deviation 2020-O0013 extends the eligible paid leave period through September 30, 2021, pursuant to the American Rescue Plan Act of 2021. Contracting Officers (COs) may use Defense Federal Acquisition Regulation Supplement (DFARS) 231.205-79 to reimburse contractors for paid leave costs incurred to keep employees in a ready state during the COVID-19 public health emergency. COs must avoid duplication of payments from other COVID-19 relief programs such as the Paycheck Protection Program.

Required actions:

1. Use DFARS 231.205-79 as the framework when implementing CARES Act section 3610 reimbursements.
2. Establish in writing that a contractor is an 'affected contractor' before authorizing reimbursement.
3. Secure representations from contractors regarding any other COVID-19 relief claimed or received to prevent duplicate payments.
4. Reduce maximum reimbursement by any credits the contractor is allowed under the Families First Coronavirus Response Act, the CARES Act or other applicable law.
5. Obligate reimbursement funds on a separate line item citing section 3610 of the CARES Act as the purpose.

This memorandum rescinds Class Deviation 2020-O0012 and its Revision 1. The national emergency declared March 13, 2020 was terminated by H.J. Res 7. Contracting Officers must now follow Defense Federal Acquisition Regulation Supplement (DFARS) subpart 217.74 for undefinitized contract actions.

2020-O0010, Class Deviation 2020-O0010 – Revision 2 - Progress Payment Rates

Revision 2 supersedes Revision 1 of this deviation. For large business concerns, Contracting Officers (COs) must return to the standard Federal Acquisition Regulation (FAR) 52.232-16 progress payment rate of 80 percent for new contracts awarded on or after July 7, 2023. For small business concerns, COs continue using the deviation version of Defense Federal Acquisition Regulation Supplement (DFARS) 252.232-7004, which sets the progress payment rate at 95 percent.

Required actions:

Contracting Officers must include the clause in all solicitations and contracts, including commercial (Part 12) acquisitions. The clause governs SOFA status, personnel accountability, compliance with Japanese law and USFJ instructions.

2018-O0002, Class Deviation 2018-O0002 - One Time Deviations––Section 830(d) Pilot Program for Acceleration of Foreign Military Sales

This deviation authorizes a pilot program to reform and accelerate contracting and pricing for up to 10 FMS contracts covering full rate production of major weapon systems. Participating Contracting Officers (COs) base price reasonableness on actual Department of Defense (DoD) cost and pricing data for the same product. COs have broad discretion in determining the amount of certified cost and pricing data required.

Required actions:

1. Obtain prior approval from the Director, DP/Defense Procurement and Acquisition Policy, using the attached application template before participating in the pilot.

2017-O0009, Class Deviation 2017-O0009 Products and Services from the African Host Nation-Djibouti

This deviation implements NDAA FY2017 section 899A, which authorizes Department of Defense (DoD) to limit competition to, or provide a preference for, products and services from Djibouti. Contracting Officers (COs) may use these authorities without a Federal Acquisition Regulation (FAR) 6.3 justification and approval or the Balance of Payments Program. New Defense Federal Acquisition Regulation Supplement policy sections and three new clauses support the authority.

Required actions:

1. Before using a procedure under 225.7798-3(a), prepare and execute a written determination per 225.7798-4. COs sign individual determinations for acquisitions under $93 million.
2. Use provision 252.225-7985 in solicitations that also include clause 252.225-7986 and insert the USAFRICOM price evaluation factor in paragraph (d).

2017-O0004, Class Deviation 2017-O0004 - Contractor Personnel Performing in the United States Central Command Area of Responsibility

This deviation requires Contracting Officers to use clause 252.225-7995 in lieu of Defense Federal Acquisition Regulation Supplement (DFARS) 252.225-7040 for contracts with performance in the USCENTCOM AOR. It rescinds Class Deviation 2015-O0009. A key change requires contractors to account for all personnel in SPOT regardless of contract value or length of performance.

Required actions:

1. Use deviation clause 252.225-7995 in place of DFARS 252.225-7040 in all solicitations and contracts requiring performance in the USCENTCOM AOR.

The USAFRICOM Commander requires SPOT tracking for all contractors in the AOR regardless of contract length or value.

This deviation replaces Federal Acquisition Regulation (FAR) 8.404(d) for Department of Defense ordering activities using Federal Supply Schedules. General Services Administration's fair and reasonable price determination covers schedule contract establishment only. Contracting Officers must independently determine fair and reasonable pricing for individual orders, Blanket Purchase Agreements (BPAs) and orders under BPAs using techniques at FAR 15.404-1.

Required actions:

1. Apply the deviation version of FAR 8.404(d) in lieu of the standard FAR text when using Federal Supply Schedules.
2. Make an independent fair and reasonable price determination for each order, BPA and order under a BPA using proposal analysis techniques at FAR 15.404-1.
3. Calibrate the level of pricing analysis detail to the complexity and circumstances of each acquisition.

2014-O0007, Class Deviation 2014-O0007 - Prohibition on the Use of the 8(a) Business Development Program for Acquisition of Military Simulation and Military Simulation Training

Effective January 30, 2014, Contracting Officers may not award prime contracts under the Section 8(a) program for military simulation or military simulation training. This prohibition covers both competitive and sole-source awards. It implements a court-approved settlement in DynaLantic Corp. v. Department of Defense.

Required actions:

1. Do not use Federal Acquisition Regulation subpart 19.8 for procurements involving military simulation or military simulation training contracts.
2. Treat contracts already in effect as of January 28, 2014 as exempt from the prohibition.
3. If a proposed contracting action may involve military simulation, verify whether the primary purpose of the device is instruction for use, operation or maintenance of military equipment before proceeding under 8(a).

2013-O0018, Class Deviation 2013-O0018 - Past Performance Evaluation Thresholds and Reporting Requirements

This deviation establishes revised past performance evaluation thresholds for Department of Defense source selections and contractor performance reporting. It replaces Class Deviations 2012-O0017 and 2012-O0018. Thresholds vary by acquisition type: $5M for systems and operations support, $1M for services and IT and $500K for ship repair and overhaul.

Required actions:

1. Apply the deviation thresholds at Defense Federal Acquisition Regulation Supplement (DFARS) 215.304(c)(3)(i) instead of Federal Acquisition Regulation (FAR) 15.304(c)(3)(i) when evaluating past performance in negotiated competitive source selections.

2013-O0017, Class Deviation 2013-O0017 - Contractor Demobilization

This deviation creates a new Defense Federal Acquisition Regulation Supplement clause, 252.225-7997, requiring contractors to plan and execute demobilization from the Afghanistan Combined Joint Operations Area (CJOA). Contractors must submit a demobilization plan at least 120 days before the end of the performance period. Contracting Officers must insert this clause in all applicable solicitations and contracts with Afghanistan performance.

Required actions:

1. Insert clause 252.225-7997 (Deviation 2013-O0017) in all solicitations and contracts with performance in Afghanistan, except those for commodities.
2. Review and approve contractor-submitted demobilization plans, which become material parts of the contract upon acceptance.
3. Review corrective action plans (CAPs) within five calendar days when deficiencies are identified in a contractor's demobilization plan or its implementation.
4. Consider requests to extend Letters of Authorization (LOAs) submitted by contractors no later than 30 days before the current period of performance expires.

2012-O0013, Class Deviation 2012-O0013 - DCAA Policy and Procedure for Sampling Low-Risk Incurred Cost Proposals

Department of Defense contracting officers must accept either a Defense Contract Audit Agency (DCAA) audit report or a DCAA memorandum to satisfy incurred cost audit requirements. The DCAA memorandum documents a risk assessment and adequacy evaluation under Federal Acquisition Regulation (FAR) 42.705-1(b)(1)(iii). This risk-based sampling process has been in use since 1994 and includes safeguards against unacceptable risk.

Required actions:

1. Accept a DCAA audit report or a DCAA memorandum documenting a risk assessment and adequacy evaluation to satisfy audit requirements at FAR 4.804-5(a)(12), 42.705-1(b)(2) and 42.705-2(b)(2)(i).
2. Rely on the DCAA memorandum as sufficient documentation that an incurred cost proposal was deemed low-risk and not selected for further audit.

The deviation remains in effect until incorporated into the Federal Acquisition Regulation or Defense Federal Acquisition Regulation Supplement or rescinded.

Required actions:

1. Do not include any requirement for political information in solicitations or contract actions.
2. Do not use FY2012 funds to require or recommend submission of political information from any entity.

2011-O0006, Class Deviation 2011-O0006 -- Utilities Privatization-Class Deviation from FAR Part 31

This deviation allows the Head of the Contracting Activity to waive Federal Acquisition Regulation (FAR) Part 31 cost principles for qualified utility privatization contracts. Eligible contracts must be fixed-price types and meet CAS exemption or waiver conditions. It replaces the prior deviation issued under CPF Tracking Number 2007-000007.

Required actions:

1. Determine whether the contract qualifies under Attachment A conditions before applying the deviation.
2. Document in writing any waivers of FAR 31.205-20 (Interest) or FAR 31.205-41 (Taxes) per Attachment A Sections 2 and 3.
3. Report quarterly to Defense Procurement and Acquisition Policy/CPF on all contracts awarded using this deviation within 30 days of each quarter's end.

2011-O0002, Class Deviation 2011-O0002 -- Congressional Notification on Significant Contract Termination

This deviation authorizes contracting officers to deviate from Defense Federal Acquisition Regulation Supplement (DFARS) 249.7001 for certain contract terminations in Iraq and Afghanistan. The requirement to provide congressional notification before executing a termination does not apply when the terminated contract is held by a non-United States firm and involves a reduction of 100 or more contractor employees. A United States firm is one incorporated or legally organized in the United States.

Required actions:

1. Do not provide congressional notification under DFARS 249.7001 before terminating a contract held by a non-U.S. firm performed in Iraq or Afghanistan where the termination reduces employment by 100 or more contractor employees.
2. Determine whether the contractor is a U.S. firm by confirming whether it is incorporated or legally organized in the United States. Apply this deviation only if the contractor is not a U.S. firm.
