Prescription and Applicability

FAR Prescription, 13.302-5(c)

(c) The contracting officer shall insert the clause at 52.213-3, Notice to Supplier, in unpriced purchase orders.

DFARS Supplementary Guidance, 213.302-5

(a) Use the clause at 252.243-7001, Pricing of Contract Modifications, in all bilateral purchase orders.
(d) When using the clause at FAR 52.213-4, delete the reference to the clause at FAR 52.225-1, Buy American-Supplies. Instead, if the Buy American statute applies to the acquisition, use the clause at--
(i) , Buy American and Balance of Payments Program, or the appropriate alternate, as prescribed at (2); or
(ii) , Buy American -Free Trade Agreements--Balance of Payments Program, or the appropriate alternate, as prescribed at (10).

52.213-3 Notice to Supplier.

As prescribed in 13.302-5(c), insert the following clause:

Notice to Supplier (APR 1984)

This is a firm order ONLY if your price does not exceed the maximum line item or total price in the Schedule. Submit invoices to the Contracting Officer. If you cannot perform in exact accordance with this order, WITHHOLD PERFORMANCE and notify the Contracting Officer immediately, giving your quotation.
