Class Deviation 2014-O0011 - Determination of Fair and Reasonable Prices When Using Federal Supply Schedule Contracts

Summary

This deviation replaces Federal Acquisition Regulation (FAR) 8.404(d) for Department of Defense ordering activities using Federal Supply Schedules. General Services Administration's fair and reasonable price determination covers schedule contract establishment only. Contracting Officers must independently determine fair and reasonable pricing for individual orders, Blanket Purchase Agreements (BPAs) and orders under BPAs using techniques at FAR 15.404-1.

Required Contracting Officer Actions

  1. Apply the deviation version of FAR 8.404(d) in lieu of the standard FAR text when using Federal Supply Schedules.
  2. Make an independent fair and reasonable price determination for each order, BPA and order under a BPA using proposal analysis techniques at FAR 15.404-1.
  3. Calibrate the level of pricing analysis detail to the complexity and circumstances of each acquisition.

Notes

GSA Determination Scope: GSA's fair and reasonable determination applies only to establishing the schedule contract. It does not cover individual orders or BPAs.

Effective Date: This deviation takes effect immediately upon issuance and remains in effect until incorporated into the DFARS or rescinded.
