Class Deviation 2021-O0004 - Requirements for Contractor Personnel Performing in the U.S. Southern Command Area of Responsibility
Summary
This deviation rescinds and supersedes class deviation 2014-O0016. Contracting Officers must use a new Defense Federal Acquisition Regulation Supplement (DFARS) clause, 252.225-7987, in place of DFARS 252.225-7040 for USSOUTHCOM performance. The new clause adds annual medical recertification, SPOT tracking and personnel recovery requirements.
Required Contracting Officer Actions
- Use deviation clause 252.225-7987 in lieu of DFARS 252.225-7040 in all solicitations and contracts requiring performance in the USSOUTHCOM area of responsibility.
- Generate SPOT letters of authorization for U.S. citizen and TCN contractor personnel traveling to, from or within the USSOUTHCOM AOR.
- Coordinate with the USSOUTHCOM J341 Protection Branch before notifying contractors which weapons and ammunition are authorized.
- Direct contractors to ensure all personnel complete annual USSOUTHCOM human rights awareness training and meet medical screening requirements before travel.
- Ensure contractors enter and maintain required personnel data in the SPOT system and check SPOT Business Rules at least every 30 days.

Notes
Supersession: This deviation fully rescinds class deviation 2014-O0016. COs must replace any prior clause inclusions based on that deviation.
Duration: The deviation remains in effect until incorporated into the DFARS or formally rescinded. No sunset date is specified.
