Class Deviation 2024-O0002 - Revision 1 – The Service-Disabled Veteran-Owned Small Business Program
Summary
This class deviation revises and supersedes Class Deviation 2024-O0002, issued December 8, 2023. It provides an alternative to using the System for Award Management (SAM) to verify eligibility of Service-Disabled Veteran-Owned Small Business (SDVOSB) concerns. Contracting officers must check the Dynamic Small Business Search (DSBS) instead of SAM to confirm SDVOSB certification.
Required Contracting Officer Actions
- Do not use SAM to verify SDVOSB concern eligibility for set-aside or sole-source awards under the SDVOSB Program.
- Check DSBS at https://web.sba.gov/pro-net/search/dsp_dsbs.cfm to verify that the offeror is certified as an SDVOSB concern.
- Use these alternate verification procedures in lieu of the procedures at Federal Acquisition Regulation 19.1403, 19.1405(c) and 19.1406(b) that require a SAM check.
Notes
Trigger for Rescission: This deviation remains in effect until SAM and DSBS are updated to align with FAR revisions. It may also be rescinded earlier. No fixed expiration date applies.
Underlying Rule: The interim rule for FAR Case 2022-009 drove these changes. That rule published at 89 FR 13950 and took effect February 23, 2024.
Pending Applications: This deviation does not alter any requirements or procedures relating to pending applications for SDVOSB certification.
