This revision supersedes Class Deviation 2024-O0006, issued February 6, 2024. It corrects typographical errors in a cross-reference in the provision and in the clause title. The deviation implements section 804 of the National Defense Authorization Act for Fiscal Year 2024, prohibiting contracts with entities that have Russian fossil fuel business operations.

Required Contracting Officer Actions

  1. Use provision 252.225-7966, Prohibition Regarding Russian Fossil Fuel Business Operations--Representation, in solicitations that include clause 252.225-7967.
  2. Use clause 252.225-7967, Prohibition Regarding Russian Fossil Fuel Business Operations, in solicitations and contracts valued above the simplified acquisition threshold, including commercial (Part 12) acquisitions.
  3. Apply clause 252.225-7967 to all contracts except those jointly determined by the Secretary of Defense and Secretary of State to be necessary for humanitarian assistance, vital to national security interests or pre-existing fossil fuel operations outside Russia; contracts related to U.S. consular offices and diplomatic posts in Russia; or contracts licensed by the Office of Foreign Assets Control of the Department of the Treasury.
  4. Notify Defense Pricing and Contracting, Contract Policy at osd.pentagon.ousd-a-s.mbx.dpc-cp@mail.mil when entering a contract under an exception.
  5. Include a copy of the joint determination made by the Secretary of Defense and the Secretary of State in the notification and in the contract file.
