Class Deviation 2026-O0015 - DFARS RFO Implementation (Part 44), Revision 1
Summary
This deviation revises and supersedes Class Deviation 2026-O0015, issued December 18, 2025. It implements the Revolutionary FAR Overhaul (RFO) for FAR Part 44 and Defense FAR Supplement (DFARS) Part 244, Subcontracting Policies and Procedures. Contracting officers must use the RFO versions of FAR Part 44, DFARS Part 244 and DFARS Procedures, Guidance, and Information (PGI) 244 in lieu of codified text.
Required Contracting Officer Actions
- Use the revised FAR Part 44 from the RFO web page (https://www.acquisition.gov/far-overhaul/far-part-deviation-guide/far-overhaul-part-44). It replaces the codified text at 48 CFR chapter 1.
- Use the attached revised DFARS Part 244. It replaces the codified text at 48 CFR chapter 2.
- Use the attached revised PGI 244. It replaces the PGI text on the Defense Pricing, Contracting, and Acquisition Policy web page.
- Insert clause 252.244-7998, Contractor Purchasing System Administration--Basic, in solicitations and contracts containing FAR 52.244-2, Subcontracts. This is prescribed at DFARS 244.070(a)(1).
- Insert clause 252.244-7998, Contractor Purchasing System Administration--Alternate I, in solicitations and contracts containing 252.246-7007, Contractor Counterfeit Electronic Part Detection and Avoidance System, but not FAR 52.244-2. This is prescribed at DFARS 244.070(a)(2).
- Insert clause 252.244-7999, Subcontracts for Commercial Products and Commercial Services, in solicitations and contracts. Use in all acquisitions, including commercial (Part 12) acquisitions.
- Do not apply DFARS 244.3 purchasing system review requirements to nontraditional defense contractors. Section 1826(a)(6) of the NDAA for FY 2026 exempts them.
- When the head of the contracting activity (HCA) determines that applying purchasing system requirements to a nontraditional defense contractor is in the best interest of the Department of Defense (DoD), document a written determination to waive the exemption. The HCA may delegate this authority no lower than the chief of the contracting office.
- Do not withhold consent to subcontract without written approval of the program manager or comparable requiring activity official, when the contractor has an approved purchasing system. This implements section 824 of the NDAA for Fiscal Year 2019 (Pub. L. 115-232).
- When reviewing purchasing system findings, reference the updated cross-reference at PGI 244.301-70(c)(3)(ii)(A). It now cites 252.242-7998, Contractor Business Systems (DEVIATION 2026-O0050), not 252.242-7005.

Notes
Nontraditional Contractor Exemption: Section 1826(a)(6) of the NDAA for FY 2026 exempts nontraditional defense contractors from establishing and maintaining an acceptable purchasing system. The HCA retains authority to waive this exemption by written determination.
Cross-Reference Update: PGI 244.301-70(c)(3)(ii)(A) now references 252.242-7998, Contractor Business Systems (DEVIATION 2026-O0050). The prior reference to 252.242-7005 is superseded.
Supersession: This revision supersedes Class Deviation 2026-O0015 issued December 18, 2025. It remains in effect until rescinded or incorporated into the FAR, DFARS and DFARS PGI.
