Class Deviation 2026-O0015 - DFARS RFO Implementation (Part 44)

Summary

This deviation implements the Revolutionary Federal Acquisition Regulation (FAR) Overhaul for FAR Part 44 and Defense FAR Supplement (DFARS) Part 244, covering subcontracting policies and procedures. Effective 2026-02-01, contracting officers must use revised versions of FAR Part 44, DFARS Part 244 and DFARS Procedures, Guidance, and Information (PGI) 244 in place of codified text. The deviation remains in effect until rescinded or incorporated into the FAR, DFARS and DFARS PGI.

Required Contracting Officer Actions

  1. Effective 2026-02-01, use the revised FAR Part 44 from the RFO web page. It replaces the codified text at 48 CFR chapter 1.
  2. Effective 2026-02-01, use the attached DFARS Part 244 from this deviation. It replaces the codified text at 48 CFR chapter 2.
  3. Effective 2026-02-01, use the attached DFARS PGI 244 from this deviation. It replaces the PGI text on the Defense Pricing, Contracting, and Acquisition Policy web page.
  4. Insert clause 252.244-7998, Contractor Purchasing System Administration--Basic, in solicitations and contracts containing FAR 52.244-2, Subcontracts.
  5. Insert clause 252.244-7998, Contractor Purchasing System Administration--Alternate I, in solicitations and contracts containing 252.246-7007, Contractor Counterfeit Electronic Part Detection and Avoidance System. Use only when FAR 52.244-2 is not present.
  6. Insert clause 252.244-7999, Subcontracts for Commercial Products and Commercial Services, in solicitations and contracts. Include solicitations and contracts using FAR Part 12 procedures for commercial products and commercial services.

CPSR threshold: The administrative contracting officer (ACO) determines the need for a contractor purchasing system review (CPSR) when a contractor's sales to the Government are expected to exceed $50 million during the next 12 months.

Alternate I applicability: Clause 252.244-7998 Alternate I applies only to contractors subject to Cost Accounting Standards under 41 U.S.C. chapter 15. Its system criteria are limited to counterfeit part detection, organizational structure and source selection requirements.

Commercial item threshold: Items valued at less than $10,000 per item purchased for use across multiple Department of Defense (DoD) and non-DoD contracts, and not identifiable to any particular contract when purchased, must be treated as commercial products per 10 U.S.C. 3457(c).
