Class Deviation 2026-O0018 - DFARS RFO Implementation (Part 23)

Summary

The deviation implements the Revolutionary Federal Acquisition Regulation (FAR) Overhaul for FAR Part 23 and Defense FAR Supplement (DFARS) Part 223, Sustainable Acquisition, Material Safety, and Pollution Prevention. Effective 2026-02-01, contracting officers must use revised versions of FAR Part 23, DFARS Part 223 and DFARS Procedures, Guidance, and Information (PGI) 223. This deviation implements E.O. 14275 and E.O. 14265, which direct removal of unnecessary regulatory provisions and elimination of unnecessary supplemental regulations.

Required Contracting Officer Actions

  1. Effective 2026-02-01, use the revised FAR Part 23 from the RFO web page. It replaces the codified text at 48 CFR chapter 1.
  2. Effective 2026-02-01, use the attached DFARS Part 223. It replaces the codified text at 48 CFR chapter 2.
  3. Effective 2026-02-01, use the attached PGI 223 in lieu of the PGI text on the Defense Pricing, Contracting, and Acquisition Policy web page.
  4. Use clause 252.223-7001, Hazard Warning Labels, in solicitations and contracts requiring submission of hazardous material data sheets per FAR 23.302(c).
  5. Use clauses 252.223-7002, Safety Precautions for Ammunition and Explosives, and 252.223-7003, Change in Place of Performance--Ammunition and Explosives. Use both in all solicitations and contracts for acquisitions involving ammunition and explosives under DFARS 223.370-1.
  6. Insert clause 252.223-7006, Prohibition on Storage, Treatment, and Disposal of Toxic or Hazardous Materials (Basic or Alternate I). Insert in all solicitations and contracts requiring, permitting or potentially permitting contractor access to a DoD installation.
  7. Insert the Basic clause at 252.223-7006 unless a determination is made under 223.7104(a)(10). Insert Alternate I when the Secretary of the military department issues a determination under 223.7104(a)(10).
  8. Insert clause 252.223-7007, Safeguarding Sensitive Conventional Arms, Ammunition, and Explosives. Use in all solicitations and contracts to which DoD Manual 5100.76 applies per 223.7201.
  9. Use clause 252.223-7008, Prohibition of Hexavalent Chromium, in solicitations and contracts for supplies, maintenance and repair services, or construction. Include commercial (Part 12) acquisitions. Do not use if an exception under 223.7304 applies or use is authorized under 223.7305.
  10. Use clause 252.223-7009, Prohibition of Procurement of Fluorinated Aqueous Film-Forming Foam Fire-Fighting Agent for Use on Military Installations. Use in solicitations and contracts relating to fire-fighting on military installations, including commercial (Part 12) acquisitions.
  11. Before issuing a solicitation for fire-fighting agent containing perfluoroalkyl or polyfluoroalkyl substances exceeding one part per billion, obtain documentation of the ocean-going vessel exemption from the requiring activity. Maintain the documentation in the contract file.
  12. Follow PGI 223.107-1(a)(i) when procuring or specifying Environmental Protection Agency-designated items containing recovered material.
  13. Follow procedures at PGI 223.370-4 for preaward and postaward administration of ammunition and explosives safety requirements.
  14. For hexavalent chromium authorization, ensure program executive office approvals are included in the solicitation and contract per PGI 223.7305.

Expiration: This deviation remains in effect until rescinded or incorporated into the FAR, DFARS and DFARS PGI. No calendar expiration date applies.

Ozone-Depleting Substances: No DoD contract may include a specification requiring a Class I ozone-depleting substance unless authorized at the general or flag officer or Senior Executive Service level per 10 U.S.C. 3201 note prec. This restriction applies to all DoD contracts regardless of place of performance, effective after June 1, 1993.

Hexavalent Chromium Prohibition Threshold: No contract may include a specification resulting in more than 0.1 percent hexavalent chromium by weight in any homogeneous material where proven substitutes exist. Exceptions apply for legacy systems and sustainment contracts under 223.7304.

PFAS Fire-Fighting Agent: Do not procure any fire-fighting agent containing perfluoroalkyl substances or polyfluoroalkyl substances exceeding one part per billion. Procurements solely for ocean-going vessels are exempt.
