Class Deviation 2026-O0021 - DFARS RFO Implementation (Part 10)

Summary

The deviation replaces Federal Acquisition Regulation (FAR) Part 10 and Defense Federal Acquisition Regulation Supplement (DFARS) Part 210, covering market research. Effective 2026-02-01, contracting officers must use the revised FAR Part 10 from the Revolutionary FAR Overhaul (RFO) web page and the attached DFARS Part 210 and DFARS Procedures, Guidance and Information (PGI) 210 in lieu of the codified text. The deviation implements E.O. 14275, E.O. 14265 and Office of Management and Budget memorandum M-25-26.

Required Contracting Officer Actions

1. Effective 2026-02-01, use the revised FAR Part 10 from the RFO web page. It replaces the codified text at 48 CFR chapter 1.
2. Effective 2026-02-01, use the attached DFARS Part 210. It replaces the codified text at 48 CFR chapter 2.
3. Effective 2026-02-01, use the attached DFARS PGI 210. It replaces the PGI text on the Defense Pricing, Contracting and Acquisition Policy web page.
4. Before issuing a solicitation with tiered evaluation of offers, conduct market research appropriate to the circumstances.
5. Use market research results to determine whether FAR Part 19 criteria are met for small business set-asides. For task or delivery orders, determine whether sufficient qualified small business concerns exist to justify limiting competition.
6. If you cannot determine whether FAR Part 19 criteria are met, include a written explanation in the contract file stating why the determination could not be made.
7. Use market research, where appropriate, to inform price reasonableness determinations under DFARS 212.204(a) and 215.4.
8. Follow DFARS PGI 210.001(e) procedures for contract file documentation of market research results.
