Summary

Effective 2026-02-01, contracting officers must use revised Federal Acquisition Regulation (FAR) Part 46 and Defense FAR Supplement (DFARS) Part 246 from the Revolutionary FAR Overhaul (RFO) in lieu of the codified text. The deviation also replaces the DFARS Procedures, Guidance, and Information (PGI) 246 text. It implements E.O. 14275, E.O. 14265 and Office of Management and Budget Memorandum M-25-26 to streamline procurement regulations.

Required Contracting Officer Actions

  1. Effective 2026-02-01, use the revised FAR Part 46 from the RFO web page. It replaces the codified text at 48 CFR chapter 1.
  2. Effective 2026-02-01, use the attached DFARS Part 246, Quality Assurance. It replaces the codified text at 48 CFR chapter 2.
  3. Effective 2026-02-01, use the attached PGI 246, Quality Assurance. It replaces the PGI text on the Defense Pricing, Contracting, and Acquisition Policy web page.
  4. Insert clause 252.246-7003, Notification of Potential Safety Issues, in solicitations and contracts, including those using FAR Part 12 (commercial) procedures, for critical safety items, integral systems and subsystems or related repair and overhaul services.
  5. Insert clause 252.246-7004, Safety of Facilities, Infrastructure, and Equipment for Military Operations, in solicitations and contracts, including commercial (Part 12) acquisitions, for construction, installation, repair, maintenance or operation of facilities configured for occupancy during military operations.
  6. Insert clause 252.246-7007, Contractor Counterfeit Electronic Part Detection and Avoidance System, when procuring electronic parts, end items containing electronic parts or related services. Do not use in solicitations and contracts set aside for small business.
  7. Insert clause 252.246-7008, Sources of Electronic Parts, in solicitations and contracts, including commercial (Part 12) acquisitions, when procuring electronic parts, end items containing electronic parts or related services.
  8. When the solicitation includes clause 252.211-7003 and a warranty for serialized items is anticipated, insert provision 252.246-7005, Notice of Warranty Tracking of Serialized Items, if offerors must enter warranty data with their offer.
  9. When the solicitation includes clause 252.211-7003 and a warranty for serialized items is anticipated, insert clause 252.246-7006, Warranty Tracking of Serialized Items, in the solicitation and contract.
  10. Insert clause 252.246-7002, Warranty of Construction (Germany), instead of FAR 52.246-21 for fixed-price construction contracts performed in Germany.
  11. Insert clause 252.246-7998, Warranty of Data (Basic, Alternate I or Alternate II), when a solicitation includes clause 252.227-7989 and greater warranty protection is needed than FAR Part 46 provides. Select the alternate based on contract type per 246.710(1).
  12. Do not use 252.246-7000, which is reserved.

Deviation Duration: This deviation remains in effect until rescinded or incorporated into the FAR, DFARS and DFARS PGI. There is no fixed expiration date.

Quality Assurance at Source Threshold: Do not require Government contract quality assurance at source for contracts or delivery orders below $400,000 unless the criteria at DFARS 246.402 are met.

Warranty Approval: The chief of the contracting office must approve warranty use except for commercial (Part 12) acquisitions, technical data without extended liability, higher-level quality requirement contracts and construction contracts using standard guide specification warranties.

Warranty Attachments: Complete warranty attachments electronically using the fillable PDF or Excel format on the Product Data Reporting and Evaluation Program (PDREP) website. Upload completed attachments to the Electronic Data Access system.
