Summary

The deviation replaces Federal Acquisition Regulation (FAR) Part 19 and Defense FAR Supplement (DFARS) Part 219, both covering Small Business, with revised versions. It also replaces the DFARS Procedures, Guidance, and Information (PGI) 219 and Appendix I, Policy and Procedures for the DoD Mentor-Protégé Program. The deviation implements E.O. 14275, E.O. 14265 and Office of Management and Budget (OMB) Memorandum M-25-26 to streamline procurement regulations.

Required Contracting Officer Actions

  1. Effective 2026-02-01, use the revised FAR Part 19 from the Revolutionary FAR Overhaul (RFO) web page. It replaces the codified text at 48 CFR chapter 1.
  2. Effective 2026-02-01, use the attached DFARS Part 219. It replaces the codified text at 48 CFR chapter 2.
  3. Effective 2026-02-01, use the attached DFARS PGI 219. It replaces the PGI text on the Defense Pricing, Contracting, and Acquisition Policy web page.
  4. Effective 2026-02-01, use the attached Appendix I, Policy and Procedures for the DoD Mentor-Protégé Program. It replaces the Appendix I on the Defense Pricing, Contracting, and Acquisition Policy web page.
  5. Insert provision 252.219-7000, Advancing Small Business Growth, in solicitations when the estimated annual contract value exceeds the applicable small business size standard in dollars or $70 million when the size standard is expressed in number of employees.
  6. Insert clause 252.219-7996, Small Business Subcontracting Plan (DoD Contracts)--Basic, in solicitations and contracts that contain FAR 52.219-9 basic, Alternate I or Alternate II.

  11. Insert clause 252.219-7010, Notification of Competition Limited to Eligible 8(a) Participants--Partnership Agreement, instead of FAR 52.219-18 in competitive solicitations and contracts processed under the PA when using FAR 19.108-7 procedures.
  12. Insert clause 252.219-7011, Notification to Delay Performance, in solicitations and purchase orders issued under the PA.
  13. Insert provision 252.219-7012, Competition for Religious-Related Services, in solicitations for religious-related services on U.S. military installations set aside for small business concerns identified in FAR 19.000(a)(3).

Test Program expiration: The DoD Test Program for Negotiation of Comprehensive Small Business Subcontracting Plans expires on December 31, 2027.

Mentor-Protégé credit cutoff: For mentor-protégé agreements before December 23, 2022, only eligible developmental assistance costs incurred by September 30, 2026 may be credited toward subcontracting goals.

PA availability: The PA between DoD and the Small Business Administration (SBA) is available at PGI 219.108-1.
