Class Deviation 2026-O0042 - DFARS RFO Implementation (Part 9)

Summary

This deviation implements the Revolutionary Federal Acquisition Regulation (FAR) Overhaul for contractor qualifications. Contracting officers must use the revised FAR Part 9 and the attached Defense FAR Supplement (DFARS) Part 209 in lieu of codified text. The deviation remains in effect until rescinded or incorporated into the FAR, DFARS and DFARS Procedures, Guidance, and Information (PGI).

Required Contracting Officer Actions

  1. Effective 2026-02-17, use the revised FAR Part 9 from the RFO web page. It replaces the codified text at 48 CFR chapter 1.
  2. Effective 2026-02-17, use the attached DFARS Part 209. It replaces the codified text at 48 CFR chapter 2.
  3. Effective 2026-02-17, use the attached DFARS PGI 209. It replaces the PGI text on the Defense Pricing, Contracting, and Acquisition Policy web page.
  4. Insert provision 252.209-7002, Disclosure of Ownership or Control by a Foreign Government, in all solicitations when access to proscribed information is required for contract performance. Use unless the solicitation includes FAR 52.204-7.
  5. Insert clause 252.209-7004, Subcontracting with Firms that are Owned or Controlled by the Government of a Country that is a State Sponsor of Terrorism. Use in solicitations and contracts valued at $200,000 or more.
  6. Insert provision 252.209-7006, Limitations on Contractors Acting as Lead System Integrators. Use in solicitations for major system acquisitions where the strategy envisions a lead system integrator.
  7. Insert clause 252.209-7007, Prohibited Financial Interests for Lead System Integrators. Use in solicitations that include 252.209-7006 and in contracts where the contractor will serve as a lead system integrator.
  8. Insert provision 252.209-7008, Notice of Prohibition Relating to Organizational Conflict of Interest--Major Defense Acquisition Program. Use only when the solicitation includes clause 252.209-7009.
  9. Insert clause 252.209-7009, Organizational Conflict of Interest--Major Defense Acquisition Program. Use in solicitations and contracts for systems engineering and technical assistance for major defense acquisition programs or pre-major defense acquisition programs.
  10. Insert clause 252.209-7010, Critical Safety Items. Use in solicitations and contracts when the acquisition includes one or more items designated as critical safety items.
  11. Insert provision 252.209-7011, Representation for Restriction on the Use of Certain Institutions of Higher Education. Use in solicitations for acquisitions to an institution of higher education, including commercial (Part 12) acquisitions.
  12. Insert provision 252.209-7012, Prohibition Relating to Conflicts of Interest in Consulting Services--Certification. Use in solicitations assigned a North American Industry Classification System (NAICS) code beginning with 5416, including commercial (Part 12) service acquisitions. Do not use in solicitations for commercial products.
  13. Direct waiver requests and exception requests for lead system integrators to the Office of the Principal Director, Defense Pricing, Contracting, and Acquisition Policy at osd.pentagon.ousd-a-s.mbx.dfars@mail.mil.

Notes

Confucius Institute waiver authority sunset: The waiver authority for the Confucius Institute restriction expires 2026-10-01. Any waiver issued before that date will not apply on or after that date.

Foreign government ownership waiver: The Secretary of Defense has delegated authority to grant national security waivers under 10 U.S.C. 4874(b)(1)(A) to the Under Secretary of Defense for Intelligence. Waiver requests must route through the Principal Director, Defense Pricing, Contracting, and Acquisition Policy.

Consulting services conflict of interest: For contracts with a NAICS code beginning with 5416, contracting officers must not award to offerors that hold consulting service contracts with covered foreign entities unless a conflict-of-interest mitigation plan is approved. Waivers require notification to Congress within 30 days.
