Summary

This deviation replaces Federal Acquisition Regulation (FAR) Part 4 and Defense FAR Supplement (DFARS) Part 204 with revised versions published under the Revolutionary FAR Overhaul (RFO). It also replaces the DFARS Procedures, Guidance, and Information (PGI) 204 text. The deviation implements Executive Orders 14275 and 14265 and Office of Management and Budget Memorandum M-25-26, which direct elimination of unnecessary procurement regulations.

Required Contracting Officer Actions

  1. Effective 2026-02-17, use the revised FAR Part 4 from the RFO web page. It replaces the codified text at 48 CFR chapter 1.
  2. Effective 2026-02-17, use the attached DFARS Part 204. It replaces the codified text at 48 CFR chapter 2.
  3. Effective 2026-02-17, use the attached DFARS PGI 204. It replaces the PGI text published on the Defense Pricing, Contracting, and Acquisition Policy web page.
  4. When using FAR 52.204-7, System for Award Management, insert provision 252.204-7998, Alternate A, Annual Representations and Certifications, and do not include separately in the solicitation the provisions listed at DFARS 204.208-70(b).
  5. Insert clause 252.204-7002, Payment for Contract Line or Subline Items Not Separately Priced, in solicitations and contracts when the price for items not separately priced is included in the price of another line or subline item.
  6. Insert clause 252.204-7006, Billing Instructions--Cost Vouchers, in solicitations and contracts for cost-reimbursement, time-and-materials or labor-hour contracts.
  7. Insert clause 252.204-7023, Reporting Requirements for Contracted Services (Basic or Alternate I), in solicitations, contracts, agreements and orders with total estimated value exceeding $3 million for specified service acquisition portfolio groups.
  8. Insert provision 252.204-7024, Notice on the Use of the Supplier Performance Risk System (SPRS), in solicitations for supplies and services not exempted by Department of Defense Instruction (DoDI) 5000.79.
  9. Insert clause 252.204-7004, Antiterrorism Awareness Training for Contractors, in solicitations and contracts including commercial (Part 12) acquisitions when contractor personnel require routine physical access to a Federally-controlled facility or military installation.
  10. Insert clause 252.204-7010, Requirement for Contractor to Notify DoD if the Contractor's Activities are Subject to Reporting Under the U.S.-International Atomic Energy Agency Additional Protocol, in solicitations and contracts for research and development or major defense acquisition programs involving fissionable materials, other radiological source materials or nuclear power production technologies.
  11. Insert clause 252.204-7014, Limitations on the Use or Disclosure of Information by Litigation Support Contractors, in all solicitations and contracts involving litigation support services, including commercial (Part 12) acquisitions.
  12. Insert clause 252.204-7015, Notice of Authorized Disclosure of Information for Litigation Support, in solicitations and contracts involving litigation support services, including commercial (Part 12) acquisitions.
  13. Insert clause 252.204-7022, Expediting Contract Closeout, in solicitations and contracts including commercial (Part 12) acquisitions when the contracting officer intends to expedite closeout through mutual waiver of residual dollar amounts of $1,000 or less.
  14. Consider SPRS price risk and supplier risk assessments as part of every award decision. For end products identified by a material identifier, also consider item risk assessments when available.
