Summary

This deviation replaces Federal Acquisition Regulation (FAR) Part 47 and Defense FAR Supplement (DFARS) Part 247, both covering transportation. Contracting officers must use the revised FAR Part 47 from the Revolutionary FAR Overhaul (RFO) web page and the attached DFARS Part 247 and Procedures, Guidance, and Information (PGI) 247 in lieu of codified text. The deviation implements E.O. 14275 and E.O. 14265 policies to streamline procurement regulations.

Required Contracting Officer Actions

  1. Effective 2026-03-16, use the revised FAR Part 47 from the RFO web page. It replaces the codified text at 48 CFR chapter 1.
  2. Effective 2026-03-16, use the attached DFARS Part 247. It replaces the codified text at 48 CFR chapter 2.
  3. Effective 2026-03-16, use the attached PGI 247. It replaces the PGI text on the Defense Pricing, Contracting, and Acquisition Policy web page.
  4. Insert clause 252.247-7003, Pass-Through of Motor Carrier Fuel Surcharge Adjustment to the Cost Bearer. Use in solicitations and contracts, including commercial (Part 12) acquisitions, for carriage involving a motor carrier, broker or freight forwarder providing truck transportation with a fuel-related adjustment.
  5. Insert clause 252.247-7028, Application for U.S. Government Shipping Documentation/Instructions. Use in solicitations and contracts, including commercial (Part 12) acquisitions, when shipping under Bills of Lading and Domestic Route Order under free on board (FOB) origin contracts, Export Traffic Release regardless of FOB terms or foreign military sales shipments.
  6. Insert clause 252.247-7000, Hardship Conditions, in solicitations and contracts for stevedoring services.
  7. Insert clause 252.247-7002, Revision of Prices, in solicitations and contracts for stevedoring services when using negotiation.
  8. Insert clause 252.247-7007, Liability and Insurance, in solicitations and contracts for stevedoring services.
  9. Insert the basic or an alternate of clause 252.247-7023, Transportation of Supplies by Sea. Use in solicitations and contracts, including commercial (Part 12) acquisitions, except those for direct purchase of ocean transportation services. Select the basic clause, Alternate I or Alternate II based on the nature of the commercial products being transported.
  10. Insert clause 252.247-7025, Reflagging or Repair Work. Use in all time charter solicitations and contracts, including commercial (Part 12) acquisitions, for vessel transportation of supplies unless a waiver applies under 247.572(c)(2).
  11. Insert provision 252.247-7026, Evaluation Preference for Use of Domestic Shipyards--Applicable to Acquisition of Carriage by Vessel for DoD Cargo in the Coastwise or Noncontiguous Trade. Use in solicitations, including commercial (Part 12) acquisitions, that require a covered vessel for carriage of cargo for DoD.
  12. Insert clause 252.247-7027, Riding Gang Member Requirements. Use in solicitations and contracts, including commercial (Part 12) acquisitions, for charter of or carriage of cargo by a U.S.-flag vessel documented under 46 U.S.C. chapter 121.
