Summary

This deviation revises and supersedes the original Class Deviation 2026-O0048, issued on 2026-03-05. Contracting officers must use the revised Federal Acquisition Regulation (FAR) Part 15 and Defense FAR Supplement (DFARS) Part 215 in lieu of the codified text at 48 CFR chapters 1 and 2. The revision implements NDAA for FY 2026 provisions on nontraditional defense contractor exemptions, the Program to Accelerate Contracting and Pricing Processes and repeal of the major weapon system commercial product determination requirement.

Required Contracting Officer Actions

  1. Effective immediately, use the revised FAR Part 15 from the Revolutionary FAR Overhaul (RFO) web page. It replaces the codified text at 48 CFR chapter 1.
  2. Use the attached revised DFARS Part 215, Contracting by Negotiation. It replaces the text codified at 48 CFR chapter 2.
  3. Use the attached revised DFARS Procedures, Guidance, and Information (PGI) 215 and associated PGI 253 direction. They replace the PGI text on the Defense Pricing, Contracting, and Acquisition Policy web page.
  4. Insert provision 252.215-7013, Supplies and Services Provided by Nontraditional Defense Contractors, in all solicitations.
  5. Insert clause 252.215-7002, Cost Estimating System Requirements, in solicitations and contracts awarded to other than nontraditional defense contractors on the basis of certified cost or pricing data.
  6. Insert provision 252.215-7992, Only One Offer, in competitive solicitations exceeding the simplified acquisition threshold, including solicitations using FAR Part 12 procedures.
  7. Insert provision 252.215-7993, Proposal Adequacy Checklist, when certified cost or pricing data submission is required.
  8. Insert the basic or alternate of provision 252.215-7994, Requirements for Certified Cost or Pricing Data and Data Other Than Certified Cost or Pricing Data, in lieu of FAR 52.215-20 when certified cost or pricing data or data other than certified cost or pricing data will be required.
  9. Insert provision 252.215-7988, Requirements for Certified Cost or Pricing Data and Data Other Than Certified Cost or Pricing Data Under the Program to Accelerate Contracting and Pricing Processes, in lieu of the basic or Alternate I of 252.215-7994, for solicitations approved under 215.403-72.
  10. Insert clause 252.215-7989, Requirements for Certified Cost or Pricing Data and Data Other Than Certified Cost or Pricing Data--Modifications--Under the Program to Accelerate Contracting and Pricing Processes, in lieu of FAR 52.215-21 basic, Alternate I or Alternate IV, for solicitations and contracts approved under 215.403-72.
  11. Insert clause 252.215-7995, Program Should-Cost Review, in all solicitations and contracts for development or production of a major weapon system.
  12. Insert provision 252.215-7996, Notification to Offerors--Postaward Debriefings, in competitive negotiated solicitations for contract awards valued at $15 million or more.
  13. When contracting with the Canadian Commercial Corporation, insert provision 252.215-7990 and clause 252.215-7991 as prescribed at 215.110-70(b).
  14. Insert clause 252.215-7014, Exception from Certified Cost or Pricing Data Requirements for Foreign Military Sales Indirect Offsets, when 252.215-7994 is included and indirect offset costs are reasonably certain.
  15. Insert clause 252.215-7006, Use of Employees or Individual Subcontractors Who Are Members of the Selected Reserve, when a source selection evaluation factor considers use of Selected Reserve members.
  16. Insert provision 252.215-7007, Notice of Intent to Resolicit, in competitive solicitations allowing fewer than 30 days for proposals, unless an exception at 215.202-71(d) applies or the requirement is waived.
  17. Obtain certified cost or pricing data for prime contracts exceeding $10 million awarded after 2026-06-30. Use the $2.5 million threshold for contracts awarded on or before 2026-06-30.
  18. Do not require nontraditional defense contractors to submit certified cost or pricing data, make-or-buy plans, forward pricing rate agreement data or should-cost review data unless the head of the contracting activity waives the exemption in writing.

Supersession: This revision supersedes Class Deviation 2026-O0048 issued 2026-03-05. Contracting officers must use this revision immediately.

Nontraditional Defense Contractor Exemptions: Section 1826(8) and (9) of the NDAA for FY 2026 exempts nontraditional defense contractors from certified cost or pricing data and several special cost requirements. The head of the contracting activity may waive these exemptions. See PGI 215.403-71(b)(5) for waiver and notification procedures.

TINA Lite Program: The Program to Accelerate Contracting and Pricing Processes, informally known as TINA Lite, is now codified at 10 U.S.C. 3709. It transfers the pilot program from section 890 of the NDAA for FY 2019. Use provisions 252.215-7988 and 252.215-7989 for approved actions under this program.

Major Weapon System Commercial Product Determination: Section 811(a)(5) of the NDAA for FY 2026 repeals 10 U.S.C. 3455, eliminating the prior Secretary of Defense determination requirement before procuring a major weapon system as a commercial product.

Expiration: This deviation remains in effect until rescinded or incorporated into the FAR, DFARS and DFARS PGI.
