Class Deviation 2026-O0049 - DFARS RFO Implementation (Part 8)

Summary

The deviation requires contracting officers to use revised versions of Federal Acquisition Regulation (FAR) Part 8 and Defense FAR Supplement (DFARS) Part 208 in lieu of codified text. FAR Parts 38 and 51 are consolidated into the Revolutionary FAR Overhaul (RFO) version of Part 8 and marked Reserved. DFARS Part 251 and its associated Procedures, Guidance and Information (PGI) are also consolidated and marked Reserved.

Required Contracting Officer Actions

  1. Effective 2026-03-16, use the revised FAR Part 8 from the RFO web page. It replaces the codified text at 48 CFR chapter 1.
  2. Effective 2026-03-16, use the attached DFARS Part 208 in lieu of the codified text at 48 CFR chapter 2, Parts 208 and 251.
  3. Effective 2026-03-16, use the attached DFARS PGI 208 in lieu of the PGI text for Parts 208 and 251 published on the Defense Pricing, Contracting and Acquisition Policy web page.
  4. Treat FAR Parts 38 and 51 as Reserved. They are consolidated into the RFO version of FAR Part 8.
  5. Treat DFARS Part 251 and its associated PGI as Reserved. They are consolidated into DFARS Part 208.
  6. Insert clause 252.208-7999, Ordering From Government Supply Sources (Deviation 2026-O0049). Use in solicitations and contracts that include FAR clause 52.208-10, Government Supply Sources.
  7. Insert clause 252.208-7000, Intent to Furnish Precious Metals as Government-Furnished Material, in all solicitations and contracts. Omit when precious metals are unavailable from Defense Supply Center Philadelphia, when the items require no precious metals or when the acquisition is at or below the simplified acquisition threshold.
  8. Insert clause 252.251-7001, Use of Interagency Fleet Management System (IFMS) Vehicles and Related Services. Use in solicitations and contracts that authorize use of an interagency fleet.

Expiration: This deviation remains in effect until rescinded or incorporated into the FAR, DFARS and DFARS PGI. No calendar expiration date applies.

Supply Chain Risk: When acquiring information technology under Federal Supply Schedules (FSS) or enterprise software agreements, include a supply chain risk evaluation factor per DFARS Part 239.

Fair and Reasonable Pricing: The FSS schedule contract pricing determination does not satisfy the order-level fair and reasonable pricing requirement. Make a separate determination for each order, blanket purchase agreement (BPA) and order under a BPA.
