Summary
The deviation directs contracting officers to use revised FAR Part 34 and replacement Defense Federal Acquisition Regulation Supplement (DFARS) Part 234 and Procedures, Guidance, and Information (PGI) 234 for major system acquisition. It implements Executive Order (E.O.) 14275 and E.O. 14265, which require removal of unnecessary procurement regulations. The deviation remains in effect until rescinded or incorporated into the FAR, DFARS and DFARS PGI.

For cost or incentive contracts valued at $50 million or more, insert provision 252.234-7998, Notice of Earned Value Management System, in solicitations. Use the deviation version dated February 2026.

For cost or incentive contracts valued at $50 million or more, insert clause 252.234-7999, Earned Value Management System, in solicitations and contracts. Use it instead of FAR 52.234-4.

Do not apply DFARS Subpart 234.2 to contracts primarily for software, including those using a software acquisition pathway under DoD Instruction 5000.87.

For major defense acquisition programs (MDAPs) exceeding $50 million, insert the basic provision 252.234-7003 and basic clause 252.234-7004 in solicitations and contracts.

For MDAPs valued between $20 million and $50 million, insert Alternate I of provision 252.234-7003 and Alternate I of clause 252.234-7004 when directed by the program manager with OSD Deputy Director, Cost Assessment approval.
No expiration date
The deviation has no fixed expiration date. It remains in effect until rescinded or incorporated into the FAR, DFARS and DFARS PGI.
Software exemption
The earned value management system (EVMS) requirements in Subpart 234.2 do not apply to contracts primarily for software. This includes contracts using a software acquisition pathway under DoD Instruction 5000.87.
DCMA responsibility
The Defense Contract Management Agency (DCMA) determines EVMS compliance when DoD is the cognizant Federal agency.
