Summary
The deviation replaces Federal Acquisition Regulation (FAR) Part 11 and Defense FAR Supplement (DFARS) Part 211, both titled Describing Agency Needs, effective 2026-02-01. It implements the Revolutionary FAR Overhaul directed by Executive Order 14275 and Executive Order 14265. Contracting officers must use the revised FAR Part 11, attached DFARS Part 211 and attached DFARS Procedures, Guidance, and Information (PGI) 211 in place of the currently codified text.

Insert provision 252.211-7002, Availability for Examination of Specifications, Standards, Plans, Drawings, Data Item Descriptions, and Other Pertinent Documents, when contract performance requires use of specifications not listed in the Acquisition Streamlining and Standardization Information System (ASSIST) database.

Insert clause 252.211-7003, Item Unique Identification and Valuation. Use in solicitations and contracts for supplies and services involving the furnishing of supplies, including commercial (Part 12) acquisitions.

Insert clause 252.211-7008, Use of Government-Assigned Serial Numbers. Use in solicitations and contracts that contain clause 252.211-7003 and require the contractor to mark major end items.

Insert clause FAR 52.211-12, Liquidated Damages--Construction, in all construction contracts exceeding $900,000. Do not use for cost-plus-fixed-fee contracts or contracts where the contractor cannot control the pace of work.

Obtain a justification and approval before using brand name or equal purchase descriptions in sealed bidding, negotiated acquisition or simplified commercial procedures.
Expiration
This deviation remains in effect until rescinded or incorporated into the FAR, DFARS and DFARS PGI. No calendar expiration date applies.
Liquidated damages carve-out
DFARS subpart 211.4 and FAR subpart 11.4 do not apply to liquidated damages under the Test Program for Negotiation of Comprehensive Small Business Subcontracting Plans. See DFARS 219.702-70 for that coverage.
