Summary
This revision to Class Deviation 2026-O0018 replaces the original issued December 18, 2025. Contracting officers must use the revised Federal Acquisition Regulation (FAR) Part 23 and the attached Defense FAR Supplement (DFARS) Part 223 in lieu of the codified text. The deviation implements several statutory perfluoroalkyl and polyfluoroalkyl substances (PFAS) procurement restrictions and establishes new DFARS Subpart 223.4 for pollution prevention including safer cleaning products.

Do not procure covered items (nonstick cookware, upholstered furniture, carpets or rugs) containing perfluorooctane sulfonate (PFOS) or perfluorooctanoic acid (PFOA).

On or after 2026-10-01, do not issue solicitations for personal protective firefighting equipment that does not meet the most recent National Fire Protection Associate (NFPA) 1970 standard, unless the requiring activity documents the Secretary of Defense determination at 223.7402(c).

To the maximum extent practicable, procure cleaning products certified under the U.S. Environmental Protection Agency (EPA) Safer Choice program or an equivalent independent third-party program.

Do not require nontraditional defense contractors to disclose a greenhouse gas inventory as a condition of contract award unless an exception or waiver under 223.470(d) or (e) applies.

Revision supersedes original
This revision supersedes the original Class Deviation 2026-O0018 issued December 18, 2025. It implements additional statutory changes and establishes DFARS Subpart 223.4.
PFAS firefighting effective date
The PFAS prohibition on fire-fighting agent and personal protective firefighting equipment takes effect October 1, 2026. Section 315 of the NDAA for FY 2026 extended the firefighting-agent prohibition from October 1, 2023 to October 1, 2026.
NFPA 1970 standard replaces intentionally-added PFAS standard
Section 316 of the NDAA for FY 2026 replaced the intentionally-added PFAS standard for personal protective firefighting equipment with the most recent NFPA 1970 standard. That standard includes a limitation on PFAS content.
Greenhouse gas nondisclosure
DFARS 223.470 implements Section 318 of the NDAA for FY 2024. Contracting officers must not require or consider greenhouse gas emission information from nontraditional defense contractors as a condition of award, except under the exception or waiver procedures in 223.470(d) and (e).
Safer Choice cleaning products
DFARS 223.471 implements Section 856 of the NDAA for FY 2025. The requirement applies to the maximum extent practicable. Acceptable alternatives include EPA Safer Choice-certified products or products certified by a consistent independent third-party program.
Deviation remains in effect
