Summary

This deviation implements the Revolutionary Federal Acquisition Regulation (FAR) Overhaul for contractor qualifications. Contracting officers must use the revised FAR Part 9 and the attached Defense FAR Supplement (DFARS) Part 209 in lieu of codified text. The deviation remains in effect until rescinded or incorporated into the FAR, DFARS and DFARS Procedures, Guidance, and Information (PGI).

Confucius Institute waiver authority sunset
The waiver authority for the Confucius Institute restriction expires 2026-10-01. Any waiver issued before that date will not apply on or after that date.
Foreign government ownership waiver
The Secretary of Defense has delegated authority to grant national security waivers under 10 U.S.C. 4874(b)(1)(A) to the Under Secretary of Defense for Intelligence. Waiver requests must route through the Principal Director, Defense Pricing, Contracting, and Acquisition Policy.
Consulting services conflict of interest
For contracts with a NAICS code beginning with 5416, contracting officers must not award to offerors that hold consulting service contracts with covered foreign entities unless a conflict-of-interest mitigation plan is approved. Waivers require notification to Congress within 30 days.
