Class Deviation 2013-O0017 - Contractor Demobilization
Summary
This deviation creates a new Defense Federal Acquisition Regulation Supplement clause, 252.225-7997, requiring contractors to plan and execute demobilization from the Afghanistan Combined Joint Operations Area (CJOA). Contractors must submit a demobilization plan at least 120 days before the end of the performance period. Contracting Officers must insert this clause in all applicable solicitations and contracts with Afghanistan performance.
Required Contracting Officer Actions
- Insert clause 252.225-7997 (Deviation 2013-O0017) in all solicitations and contracts with performance in Afghanistan, except those for commodities.
- Review and approve contractor-submitted demobilization plans, which become material parts of the contract upon acceptance.
- Review corrective action plans (CAPs) within five calendar days when deficiencies are identified in a contractor's demobilization plan or its implementation.
- Consider requests to extend Letters of Authorization (LOAs) submitted by contractors no later than 30 days before the current period of performance expires.

Notes
Commodity Exception: The clause does not apply to solicitations or contracts for commodities. COs must verify the nature of the acquisition before inserting the clause.
LOA Extensions: LOAs may only be extended up to 30 calendar days after expiration of the current performance period. Extensions are limited to personnel needed to execute the approved demobilization plan.
SPOT Database: Contractors must update employee deployment status in the SPOT database within 72 hours of redeployment. COs should verify this requirement is communicated clearly.
Abandoned Property: Lost, abandoned or unclaimed contractor equipment coming into Government custody may be disposed of under 10 U.S.C. section 2575. The Government retains other contractual remedies as well.
Badge Return: Failure to return installation or access badges may result in delay of final payment. COs should be aware of this enforcement mechanism.
