Class Deviation 2016-O0008 - Contractor Personnel Performing in United States Africa Command Area of Responsibility
Summary
This deviation rescinds and supersedes Class Deviation 2016-O0006. Contracting Officers must use new clause 252.225-7980 in place of Defense Federal Acquisition Regulation Supplement (DFARS) 252.225-7040 in all solicitations and contracts with performance in the USAFRICOM area of responsibility. The USAFRICOM Commander requires SPOT tracking for all contractors in the AOR regardless of contract length or value.
Required Contracting Officer Actions
- Incorporate clause 252.225-7980 (DEVIATION 2016-O0008) in lieu of DFARS 252.225-7040 in all solicitations and contracts requiring performance in the USAFRICOM AOR, including commercial (Part 12) acquisitions.
- To the extent practicable, modify current active contracts with USAFRICOM AOR performance to incorporate clause 252.225-7980.
- Sign SPOT-generated letters of authorization for contractor personnel required to process through a deployment center or travel within the USAFRICOM AOR.
- Annotate SPOT-generated letters of authorization with 'None' checked for Government-furnished life-support services when such services are neither available nor authorized in the contract.
- Notify contractors of authorized weapons and ammunition when contractor personnel are approved to carry weapons under paragraph (j)(1) of the clause.
- Direct contractor personnel processing, departure points and transportation modes as required by clause paragraphs (f)(1) and (f)(2).

Notes
SPOT Tracking Scope: USAFRICOM requires SPOT tracking for all U.S. citizen and third-country national contractor personnel in the AOR. This applies regardless of contract length or dollar value, covering all operational phases including Phase 0.
Supersession: This deviation rescinds Class Deviation 2016-O0006. COs should ensure the prior deviation's clause is replaced in all active contracts to the extent practicable.
Duration: This deviation remains in effect until incorporated into the DFARS or otherwise rescinded.
