Class Deviation 2020-O0014 - Flexibilities for Electronic Delivery of Information Related to Suspensions and Debarments
Summary
This deviation responds to COVID-19 by allowing debarring and suspending officials to deliver notices and decisions electronically. Officials may use email or secure file exchange in addition to certified mail. Contractors must receive instructions for submitting opposition in writing, in person or via phone or video-teleconference.
Required Contracting Officer Actions
- Debarring and suspending officials may deliver suspension and proposed debarment notices via email or secure file exchange, in addition to certified mail with return receipt requested.
- Initial suspension or proposed debarment notices sent by email must include copies of the record that formed the basis for the decision, per Defense Federal Acquisition Regulation Supplement Appendix H-101.
- Include instructions for contractors to present opposition or evidence in writing via mail or email, in person, through a representative or via telephone or video-teleconference as the suspending and debarring official deems appropriate.
