Class Deviation 2024-O0011 - Special Acquisition Authority for Rapid Contracting for Combatant Commanders

Summary

This deviation authorizes Contracting Officers (COs) to use temporary special acquisition authorities for covered contracts supporting covered operations. Elevated micro-purchase and simplified acquisition thresholds apply, and COs may treat acquisitions as commercial. Head of the Contracting Activity (HCA) approval is required before these authorities are used.

Required Contracting Officer Actions

  1. Obtain HCA approval before applying any special acquisition authority under this deviation.
  2. Send a copy of the combatant commander's request and approved determination to Defense Pricing and Contracting (DPC) at osd.pentagon.ousd-a-s.mbx.dpc-cp@mail.mil within 7 days of receipt.
  3. Include the request and approved determination in the contract file.
  4. Enter '2024-O0011' in the 'Description of Requirements' data element and the most appropriate value in the 'Emergency Acquisition' data element in the contract action report.
  5. Notify DPC via email at osd.pentagon.ousd-a-s.mbx.dpc-cp@mail.mil when the combatant commander reports a covered operation has ended.

Notes

Expiration: This deviation expires September 30, 2028 unless rescinded earlier.

Elevated thresholds (domestic): The micro-purchase threshold is $20,000 and the simplified acquisition threshold is $800,000 for contracts awarded and performed in the United States.

Elevated thresholds (overseas): The micro-purchase threshold is $35,000 and the simplified acquisition threshold is $1.5 million for contracts awarded and performed outside the United States.

Simplified procedures ceiling: FAR subpart 13.5 simplified procedures are authorized for purchases above the simplified acquisition threshold up to $15 million.

Commercial treatment: COs may treat qualifying acquisitions as commercial products or commercial services under this deviation.

HCA delegation limit: HCA approval authority is not delegable below the senior contracting official.
