Summary

This deviation implements the revocation of Executive Order 14057 under Executive Order 14148. Contracting officers must stop using two sustainability-related provisions and replace two clauses with deviation versions. They must also amend open solicitations and modify existing contracts to reflect these changes.

Do not use 52.223-19, Compliance with Environmental Management Systems, in new solicitations and contracts.

Do not use 52.223-22, Public Disclosure of Greenhouse Gas Emissions and Reduction Goals--Representation, in new solicitations and contracts.

Use 52.223-10, Waste Reduction Program (DEVIATION 2025-O0004), in lieu of the clause at Federal Acquisition Regulation (Federal Acquisition Regulation (FAR)) 52.223-10 in new solicitations and contracts.

Use 52.223-23, Sustainable Products and Services (DEVIATION 2025-O0004), in lieu of the clause at FAR 52.223-23 in new solicitations and contracts.

Use the deviation paragraphs from Attachment 2 in lieu of the corresponding paragraphs in FAR 52.204-8, 52.212-3, 52.212-5 and 52.213-4 in new solicitations and contracts.

Amend open solicitations and modify existing contracts to remove 52.223-19 and 52.223-22.

Amend open solicitations and modify existing contracts to use the deviation versions of 52.223-10 and 52.223-23.

Amend open solicitations and modify existing contracts to use the Attachment 2 deviation paragraphs in FAR 52.204-8, 52.212-3, 52.212-5 and 52.213-4.

Consider whether to modify contract actions with six months or less remaining in the period of performance and without options to extend.

Do not consider or use the representations in the System for Award Management (SAM) for FAR 52.223-22 or paragraph (t) of FAR 52.212-3.

Do not require offerors, as a condition of contract award, to disclose a greenhouse gas inventory or any other greenhouse gas emissions report. See Class Deviation 2024-O0009.
SAM Representations
SAM may continue to prompt entities to complete representations tied to provisions no longer included in agency solicitations. Entities are not required to complete those representations. They also cannot update their SAM registration to remove them.
Greenhouse Gas Disclosure
A separate prohibition on required greenhouse gas disclosure applies. See Class Deviation 2024-O0009, Prohibition on Required Disclosure of Information Relating to Greenhouse Gas Emissions.
Effective Period
